Terms and conditions of tala vintage online store - hereinafter referred to as the online store - operating at www.talavintage.pl

Glossary

1. seller - tala vintage - Natalia Paul entered in the Central Register of Business Activity and Information (CEIDG) maintained by the minister responsible for economy, NIP 775 260 49 39, REGON 361731959.

2. Store - online store operated by the Seller at the Internet address www.talavintage.pl.

3) Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes or intends to make an order or uses other services of the Shop (including the Consumer).

4th Consumer - a natural person performing a legal action (sales contract through the Store) not directly related to his/her business or professional activity.

5. contract concluded at a distance - a contract concluded with a Customer within an organized system of contract conclusion at a distance (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.

6. Rules and Regulations - these rules and regulations of the Store.

7. Order - a declaration of will of the Customer made by means of the Order Form and aimed directly at concluding a Contract for Sale of a Product or Products with the Seller.

8) Account - Customer's account in the Store, it collects data provided by the Customer and information about orders placed by him/her in the Store.

9) Registration form - a form available in the Store that allows you to create an Account.

10) Order Form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including delivery and payment methods.

11.Basket - an element of the Store's software in which the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the details of the Order, in particular the quantity of products.

12.Product - a movable item/service available in the Store which is the subject of a Sales Agreement between the Customer and the Seller.

13. Sales Agreement - a contract of sale of a Product concluded or entered into between the Customer and the Seller through the Online Store. The Sales Agreement is also understood - applying to the characteristics of the Product - a contract for the provision of services and a contract for work. 

 

1. general information

(1) Information on all products sold and their availability can be found on the website of the store.

2.All products offered on the website of the online store are vintage items.

Carefully selected not in need of repair or thorough renovation.

3.The customer can place an order 24 hours a day using the prepared online service, indicating the products in which he is interested and putting the appropriate number of them into a virtual shopping cart.

(4) The Seller, to the fullest extent permitted by law, shall not be liable for any disruptions, including interruptions in the operation of the Store caused by force majeure, unauthorized acts of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer.

(5) rowsing the assortment of the Store does not require creating an Account. Placing orders by the Customer for Products in the assortment of the Store is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data to enable the execution of the Order without creating an Account.

6th Prices given in the Store are given in Polish zloty.

7. prices do not include the cost of shipping products. The online store reserves the right to change prices of products on offer in the store. Price changes do not include products for which an order was previously placed and confirmed.

(8) Data protection is carried out in accordance with the requirements of generally applicable laws, in particular the Act of 18.07.2002 on the provision of electronic services, and the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

(9) Personal data provided in the contact form shall be treated as confidential and shall not be visible to unauthorized persons.

2. creating an Account in the Store

1. the User is obliged to register on the Website in order to obtain a User Account allowing him to use all the functionalities of the Website.

2. a User may be an adult natural person, a legal person and an organizational unit without legal personality. Minors may use the Service provided that a User Account is established on their behalf by a parent or legal guardian.

(3) In order to register on the Website, it is necessary for the User to have a device with Internet access and an active e-mail account.

(4) Registration on the Website is done by the User filling in the registration form available on the Website or automatically at the first Purchase. Providing data as part of registration is voluntary, however, failure to provide data marked as mandatory in the registration form will prevent registration.

(5) By registering, the User represents and warrants that all the data provided by him/her are true, and in the event of any change to such data, he/she undertakes to update them immediately through the User Account.

(6) By registering, the User agrees to the processing of his/her personal data by talavintage for the purpose of recording sales and processing orders, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, national data protection regulations and the adopted Privacy Policy.

(7) By registering, the User agrees to receive system information and commercial messages from tala vintage to his/her email address.

8.Establishing an Account in the Store is free of charge.

(9) Logging into the Account is done by providing the login and password established in the Registration Form.

10. the Customer has the opportunity at any time, without giving any reason and without incurring any fees for this, to delete the Account by sending an appropriate request to the Seller, in particular by e-mail or in writing.

3 Rules for placing an Order

(1) Placing orders is done by adding the Item by the Buyer to the shopping cart, and then "Finalizing the order". 

confirming the delivery address - choosing the form of delivery and form of payment, and starting to pay for the order on the "Order" page by clicking on the "I buy and pay" icon.

With this moment the order is placed.

(2) The user will not be able to place an order until he/she enters his/her personal data necessary for order processing (first name, last name, street name and its number, postal code, city, email address, telephone number) into the form available on the "Order" page containing information about the order being made.

(3) Placing an order entails the obligation of the Buyer to pay. After payment by the Buyer, the payment for the order receives the status "Completed" and the Purchase occurs.

(4) The Buyer is obliged to make the Purchase in a thoughtful manner.

5. offered methods of delivery and payment

Personal collection available by appointment and payment of the order.

Shipping of the package to the address indicated by the customer through a courier company. Shipping costs are borne by the customer .

 6 Forms of payment

The form of payment for the order placed is prepayment or payment upon receipt of shipment.

Prepayment can be made through the PayU transaction platform.

 The applicable terms and conditions are available on their website.

(7) When choosing cash on delivery, the buyer's obligation, when a contract of sale is concluded, is to take back the item that has been sold. Thus, the mere fact that the buyer refuses to pick up the item, in a situation where the shipment has no damage and the goods are in accordance with the contract, does not affect the conclusion of the contract. (Article 535 of the Civil Code )

Then the Seller has a claim to the Buyer to pay the amount of the ordered goods, as well as any costs incurred in this regard (e.g. shipping costs, courier company storage costs, etc.).

Also, the buyer cannot change his mind and demand that the shipment be sent to him once again, since the seller's obligation has already been fulfilled with the shipment to the carrier or postal operator.

4. execution of the sales contract

(1) The conclusion of the Contract of Sale between the Customer and the Seller shall take place after the Customer places an Order using the Order Form in the Online Store in accordance with item. 3 of the Terms and Conditions.

(2) After placing an Order, the Seller shall immediately confirm its receipt and simultaneously accept the Order for execution. Confirmation of receipt of the Order and its acceptance for execution shall be made by the Seller sending the Customer an appropriate e-mail message to the Customer's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. As soon as the Customer receives the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.

(3) If the Customer chooses:

 card payment / online payment - order processing will be subject to positive authorization by the Customer's bank,

(4) The online store is not responsible for non-delivery of goods or delay in delivery of goods due to incorrectly specified delivery address or absence at the place of delivery of the recipient.

(5) If it is necessary to refund the funds for the transaction made by the Customer by payment card, the Seller will make a refund to the bank account from which the payment was made within 48 hours.

(6) Each order is accompanied by an invoice.

(7) At the time of shipment of the order, the customer receives by e-mail information about the shipment of the order. If the customer provided his phone number when placing the order, this number will be given to the courier company to facilitate contact and delivery of goods. If the shipment bears signs of external damage, please resign from receiving it and return the package to the courier with a damage report.

The customer may make changes to the order until shipment, for this purpose, please contact the store at the e-mail address kontakt@talavintage.pl or by phone 785 - 116 - 321.

In the case of cancellation of the order after the payment has been made to the account, or changes to the order associated with a reduction in the amount payable, the online store will return the money to the account from which it received the payment within 7 working days.

5 Right of withdrawal

Returns

(1) In accordance with the Act of May 30, 2014 on consumer rights (Journal of Laws 2014 item 827), the Buyer who is a consumer may, within 14 days from the date of receipt of the Item, withdraw from the contract of sale and purchase without stating a reason and without incurring costs, except for the cost specified in par. 6 para. 1 item. 7.

2nd Buyer specified above may withdraw from the contract of sale and return the Item by completing the return form and sending it to the email - kontakt@talavintage.pl in the title RETURN

3.In accordance with art.38 of the Act of May 30, 2014 on consumer rights (Journal of Laws 2014 item 827), the return is not subject to the Item not prefabricated, manufactured to the consumer's specifications or serving to meet his individualized needs (for example, the materials used, size, colors, etc. have been changed).

4th Returned Item should be sent back in an unaltered state, bearing no traces of use by the Buyer beyond what is necessary to determine the nature, characteristics and functioning of the Item.

(5) The Buyer is obliged to send back the returned Item to the Seller's address within 14 days from the date of withdrawal from the contract of sale by the Buyer.

(6) The cost of returning the Item shall be borne by the Buyer.

7. for the returned Item, the Buyer shall receive a refund of the amount paid (the Price of the Item and the cost of shipping to the Buyer, if any). The refund to the Buyer's account no later than 14 days from the date of receipt of the Buyer's statement of withdrawal from the contract is made by tala vintage unless the Seller and the Buyer agree otherwise.

 The Seller will refund the payment using the same methods of payment that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not incur any costs for him.

Exchanges

(1) Due to the unique nature of the Items offered on the Website, it is not possible to exchange them.

Complaint

(1) The Buyer may file a complaint about an Item that turned out to be defective, demanding a free repair or price reduction or withdrawal from the purchase-sale agreement. Due to the used nature of the Items offered, only defects of the Item not shown in the description or photos of the Offer are subject to complaint.

(2) The Buyer may file a claim for an Item that is inconsistent with the description or photos in the Offer, requesting a reduction in price or withdrawing from the purchase-sale agreement.

(3) In order to make a complaint about an Item, the Buyer sends a claim via email - kontakt@talavintage.pl in the title ADVERTISEMENT.

4th In order to consider a claim for mechanical damage caused during transport, it is necessary to have a damage report signed by the recipient and the provider of the shipment. At the time of receipt, the Buyer is obliged to check the condition of the consignment. If it is found damaged, the Buyer is obliged to report this fact to the supplier, write a damage protocol and contact the Seller.

6. personal data in the Online Store

(1) Personal data of Customers collected by the Administrator through the Online Store are collected for the purpose of implementing the Sales Agreement, and if the Customer agrees - also for marketing purposes.

(2) In the case of a Customer who uses a courier delivery method in the Online Store, the Administrator shall make the collected personal data of the Customer available to the selected carrier or intermediary performing shipments on behalf of the Administrator.

(3) In the case of a Customer who uses in the Online Store the method of electronic payment or payment card, the Administrator shall make available the collected personal data of the Customer to a selected entity handling the above payments in the Online Store.

(4) The Customer has the right to access the content of his data and to correct them.

(5) Provision of personal data is voluntary, although failure to provide personal data indicated in the Terms and Conditions necessary for the conclusion of the Sales Agreement results in the impossibility to conclude this agreement.

6. tala vintage is the administrator of the data of its customers. This means that if you have an Account on the site, I process your data such as name, surname, e-mail address, telephone number, address, IP address, company name and Tax ID.

7. tala vintage is also the controller of those who subscribe to the newsletter.

8. personal data is processed:

in accordance with data protection regulations,

in accordance with the implemented Personal Data Security Policy,

to the extent and for the purpose necessary for the establishment, formation of the content of the Agreement, amendment or termination thereof and proper implementation of Services provided electronically,

to the extent and for the purpose necessary to fulfill legitimate interests (legally justified purposes), and the processing does not violate the rights and freedoms of the data subject;

to the extent and for the purpose in accordance with the consent given by you if you have subscribed to the newsletter.

9. for the sake of customers' privacy, tala vintage, as the administrator of the Service's data, protects it and secures it from unauthorized access.

10. tala vintage exercises constant control over data processing and restricts access to data as much as possible. Personal data is processed by tala vintage in accordance with Article 23 (1) (1), (3) and (5) of the Act of August 29, 1997 on the Protection of Personal Data, for purposes related to the operation of the Service.

(11) Provision of any personal data is voluntary. The Customer has the right to access the content of his data and to modify them.

(12) The data provided by the Customer during registration and ordering are used only for the purposes of sales records, for contacting on matters relating to orders and for the execution of orders placed by the Buyer.

(13) In order to carry out orders placed, tala vintage provides the courier company with the Buyer's personal data. This data contains only the information necessary for the proper receipt of the shipment.

14th Users' data may be made available to state authorities entitled to receive them under applicable law and, in the event of non-payment of amounts due to tala vintage, to entities conducting debt recovery proceedings on its behalf.

(15) Tala vintage shall provide Users with the opportunity to delete personal data from the dataset. In order to delete the data, the User should send an appropriate statement to tala vintage in electronic form or in writing. Tala vintage may refuse to delete the User's data if the User has not paid the amount due to tala vintage or has violated these Regulations or applicable laws, and the preservation of the data is necessary to clarify these circumstances and determine the User's responsibility.

7. COOKIES

The Website uses cookies ("cookies"). These are text files stored by the browser on the User's device, containing, among other things, the name of the website, the time of their storage, a unique number.

The content of cookies does not allow for personal identification of the User. No personal data are processed or stored using cookies.

Cookies on the Website are used to authenticate the logged-in User, to display personalized content of the Website to the User, for statistical purposes and for Facebook (the "like" button and publication of content on Facebook) and Pinterest (the "Pin" button and publication of content on Pinterest).

8 Final provisions

1. the Seller reserves the right to make changes to the Terms and Conditions for important reasons, i.e.: changes in laws, changes in methods of payment and delivery - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer about each change at least 7 days in advance.

(2) Matters not covered by these Regulations shall be governed by generally applicable provisions of Polish law, in particular: Civil Code; the Act on Providing Electronic Services; the Act on Consumer Rights, the Act on Personal Data Protection.
